Hopcott Farms Gift Card Terms & Conditions

Agreement to Terms

These Hopcott Farms Gift Card Terms and Conditions (the “Gift Card Agreement”) describe the terms and conditions that apply to the purchase, loading, reloading, and use of physical Hopcott Farms gift cards (each a “Gift Card”).

The Hopcott Farms Gift Card program (the “Gift Card Program”) is offered and administered by Hopcott Premium Meats Ltd. (“Hopcott Farms,” “Hopcott,” “we,” “us,” or “our”).

By purchasing, accepting, loading, reloading, or using a Gift Card, you agree to be bound by this Gift Card Agreement. Please read this Gift Card Agreement carefully before purchasing, accepting, loading, reloading, or using a Gift Card.

The Gift Card Program is available only in Canada to residents of Canada, excluding residents of the Province of Quebec. Residents of Quebec are not eligible to participate in the Gift Card Program.

Purchasing Gift Cards

Gift Cards are physical cards and may be purchased:

• in-store at Hopcott Farms; or
• online through the Hopcott Farms website.

Gift Cards purchased online are physical Gift Cards and must be picked up in-store at Hopcott Farms. Any applicable ordering and pickup instructions will be provided at the time of purchase.

Gift Cards may be loaded with a minimum value of $10 CAD and a maximum value of $1,000 CAD per Gift Card.

Hopcott Farms may change the permitted minimum or maximum Gift Card values from time to time, subject to applicable law.

Gift Cards must be purchased directly from Hopcott Farms or through another sales channel expressly authorized by Hopcott Farms. Hopcott Farms is not responsible for, and may refuse to honour, Gift Cards obtained through unauthorized sellers or fraudulent means.

Authorized Use

Gift Cards may be used toward eligible purchases at Hopcott Farms, subject to the exclusions contained in this Gift Card Agreement.

Gift Cards cannot be used to purchase event tickets or to pay for online orders.

Gift Cards cannot be used to purchase another Gift Card unless expressly permitted by Hopcott Farms.

Gift Cards have no cash value and cannot be redeemed or exchanged for cash except where required by applicable law.

If the available balance on a Gift Card is less than the total amount of a purchase, you are responsible for paying the remaining balance using another payment method accepted by Hopcott Farms.

Reloading Gift Cards

Gift Cards are reloadable.

Additional funds may be added to an existing Gift Card, provided that the resulting balance does not exceed the maximum permitted Gift Card balance of $1,000 CAD.

Hopcott Farms may establish or modify procedures for reloading Gift Cards from time to time.

Expiration and Fees

Purchased Gift Cards do not expire.

No dormancy, inactivity, maintenance, or service fees will be deducted from the balance of a Gift Card.

Returns and Refunds

The purchase of a Gift Card is non-refundable, except where otherwise required by applicable law.

Merchandise purchased using a Gift Card is subject to Hopcott Farms’ standard return and refund policies.

Where a refund is approved for a purchase originally paid for using a Gift Card, the applicable refund amount will be returned to the original Gift Card.

If the original Gift Card is not available, Hopcott Farms may issue the applicable refund amount on a new Gift Card.

Where a purchase was made using a Gift Card together with another payment method, any approved refund may be returned to the applicable payment methods in accordance with Hopcott Farms’ standard return procedures.

Lost, Stolen, Damaged, or Misused Gift Cards

Gift Cards should be treated like cash.

Hopcott Farms is not responsible for lost, stolen, damaged, destroyed, or misplaced Gift Cards or for unauthorized use of a Gift Card.

Lost, stolen, damaged, destroyed, or misplaced Gift Cards and their remaining balances will not be replaced or refunded, except where required by applicable law.

You are responsible for safeguarding your Gift Card and any identifying information associated with it.

Hopcott Farms reserves the right to refuse to honour, suspend, or cancel a Gift Card if Hopcott Farms reasonably believes that the Gift Card was obtained, loaded, or used fraudulently, unlawfully, or in violation of this Gift Card Agreement.

Checking Your Gift Card Balance

You may check the available balance of your Gift Card:

online through the Hopcott Farms Program Website at https://hopcottfarms.checkyourcardbalance.com/en/login

through the Hopcott Farms loyalty app; or

in-store at Hopcott Farms.

Gift Card balances may not immediately reflect recently completed transactions or reloads where processing delays occur.

Privacy

The collection, use, and disclosure of personal information associated with the purchase, administration, or use of Gift Cards is governed by the Hopcott Farms Privacy Policy, available at:

By providing personal information in connection with a Gift Card transaction, you acknowledge that such information may be collected, used, and disclosed by Hopcott Farms in accordance with the Privacy Policy and applicable law.

Limitation of Liability

To the fullest extent permitted by applicable law, Hopcott Farms is not responsible for losses arising from the loss, theft, unauthorized use, destruction, or misuse of a Gift Card.

To the fullest extent permitted by applicable law, Hopcott Farms makes no representations or warranties, express or implied, with respect to Gift Cards except as expressly provided in this Gift Card Agreement or as required by applicable law.

If a Gift Card is defective or non-functional due to an error attributable to Hopcott Farms, Hopcott Farms may, as appropriate, replace the affected Gift Card or transfer its verified remaining balance to a replacement Gift Card.

Nothing in this Gift Card Agreement is intended to exclude, restrict, or modify any right or remedy that cannot lawfully be excluded, restricted, or modified under applicable consumer protection or other laws.

Changes to the Gift Card Program or These Terms

Hopcott Farms may amend this Gift Card Agreement or modify the Gift Card Program from time to time, subject to applicable law.

Where required by applicable law, Hopcott Farms will provide notice of a material amendment in the manner and within the time required by law.

The current version of this Gift Card Agreement will be made available through the Hopcott Farms website.

Hopcott Farms may discontinue the sale or issuance of new Gift Cards at any time, subject to applicable law. Discontinuing the sale or issuance of new Gift Cards will not, by itself, invalidate an outstanding Gift Card or its remaining balance.

Governing Law

This Gift Card Agreement and all matters relating to the Gift Card Program are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Subject to any rights you may have under applicable consumer protection laws, the parties submit to the jurisdiction of the courts of the Province of British Columbia in respect of disputes arising from or relating to this Gift Card Agreement or the Gift Card Program.

Severability

If any provision of this Gift Card Agreement is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.

Errors and Fraud

Hopcott Farms reserves the right to correct a Gift Card balance where Hopcott Farms reasonably determines that a clerical, technical, billing, or accounting error has occurred.

Hopcott Farms also reserves the right to refuse to honour, suspend, or cancel a Gift Card that Hopcott Farms reasonably determines was obtained, loaded, or used fraudulently or unlawfully, subject to applicable law.
